Attorney Lawrence Walters said defense counsel is seeking emergency relief in the form of immediate release from custody and an order prohibiting any further bond revocation based on alleged distribution of obscene materials that have not yet been deemed obscene by a judicial authority.
“We expect that these requests will receive prompt attention by the court, given the substantial constitutional rights at stake and the patently illegal incarceration of Mr. Wilson,” Walters said.
Wilson, who operates an amateur-wife-and-girlfriend website, NowThatsFuckedUp.com, was accused of violating his bail agreement last week. Prosecutors contended that the continued use of the site violated the conditions of Wilson's release and filed a motion to revoke his $151,000 bail. On Friday, Durrance granted that motion and remanded Wilson to Polk County Jail.
Wilson is currently being held in protective custody.
Wilson, 28, was arrested in October and is facing 301 obscenity charges for photos police allegedly found on his site, though he removed all explicit material from the site earlier this month. A pretrial conference is set for Feb. 7 at which time a trial date could be set.
