Clips4Sale Picks Up Lips4Sale in Cybersquatting Case

PHILADELPHIA — An arbitrator on Monday ordered the domain name Lips4Sale.com transferred to the company that owns Clips4Sale.com, which alleged the domain is confusingly similar to its own, was registered in bad faith and that its operator has no rights to it.

Clips4Sale.com, which offers millions of fetish and amateur porn video clips, won the case after presenting a key facet of its complaint — that Transcom Ltd., the company that purchased and exploited the Lips4Sale.com domain, merely deleted the letter “c” from the beginning of the word “clips” in the domain name.

Transcom’s “confusingly similar variation” of the Clips4Sale mark owned by Wiluna Holdings LLC “is a blatant attempt to trade on the goodwill” established by it, the complaint against Lips4Sale.com said.

“Consumers or potential consumers of Wiluna’s services or media, when searching the Internet, will be directed to respondent’s infringing domain name, and then redirected to related websites containing adult entertainment media and content in direct competition with services offered by complainant under the Clips4Sale marks,” the suit said. “However, respondent has no connection or affiliation with Wiluna and does not have a license or consent, express or implied, to use the Clips4Sale mark in a domain name or in any other manner.”

Lips4Sale.com’s operator, according to the complaint, has been redirecting the domain name to other websites featuring adult entertainment media, such as AdultVideos.com.

Transcom did not respond to Wiluna’s arbitration claim filed with the National Arbitration Forum, whose dispute resolution judge concluded that relief should be granted and that Lips4Sale.com be transferred.
