SALT LAKE CITY — The ACLU, various artists and Internet service providers want a federal court to stop enforcement of a 2005 Utah anti-pornography law because they say it is unconstitutional.
The Harmful to Minors Act is intended to limit the ability of minors to access porn online.
The law seeks to regulate all Internet speech that some may consider harmful to minors including art, photography and information about sexual health and other lesbian, gay, bisexual and transgender topics.
A U.S. district judge blocked enforcement of the law in 2006 after the ACLU successfully argued that the law violated the U.S. Constitution. Now, the ACLU wants the block to become permanent.
One attorney said that the law imposes “sweeping burdens on constitutionally-protected speech.”
