Cal/OSHA Takes Next Steps in Porn Performer Safety Standards

LOS ANGELES — Cal/OSHA is gearing up to present a draft of proposed rules strengthening workplace safety on porn shoots at its next advisory hearing set for June 7 in downtown Los Angeles.

Krisann Chasarik of the California Department of Industrial Relations told XBIZ that the draft will not be a finished proposal but will be a basis for discussion.

Although condoms are already mandatory under Cal/OSHA’s health code, Chasarick said the department is looking further into the standard.

“We are looking at other medical services and control measures,” she said. “There are still many steps that need to be taken before the issue enters the regulation process.”

After Cal/OSHA presents the proposed language for consideration, the advisory committee will review it and could revise it. Once it agrees on the language of the proposal, the regulation process will begin.

It will then go to the Occupational Safety and Health Standards Board, which reviews it and generally suggests editorial changes. A public hearing will be held to get public input before any action is taken.

After a written public comment period, a final statement of reasons  and a final proposed regulation will be published by the board, which will vote on whether or not to accept it.

After that, state attorneys will review the whole rulemaking package for compliance with the Administrative Procedures Act.

The June 7 meeting will take place at the Caltrans building located at 100 S. Main St., Los Angeles.
