L.A. City Council Finalizes Amendments to Safer Sex Act

LOS ANGELES — The Los Angeles City Council unanimously voted today to adopt amendments to the Safer Sex Act so it will now reflect the language and intent of Measure B.

The council voted to approve the changes to the ordinance last week, but it was held over for a second consideration or reading.

A public hearing was not held to consider the amendments to the ordinance because one had already taken place. Instead, the council voted on all of items that had previously had public hearings in bulk, save a few that were hand-picked by council members for separate consideration.

The council reserves the right to keep the file open for potential reconsideration for five days. Following that period, it will be sent to Mayor Antonio Villaraigosa to sign or reject.

A representative from Councilman Paul Kortez's office said that it is possible that the mayor will veto the ordinance, but "that almost never happens. He also said that the mayor has unlimited time to make his decision.

Villaraigosa will be replaced by incoming mayor, Eric Garcetti, in July. 

The vote also took place just one week before the present council adjourns. When the council reconvenes in July for the next legislative cycle, there will be new councilmen.

The ordinance, also known as Section 12.22.1, now includes language that requires permitees to use “barrier protection, including condoms, to shield performers from blood or other potentially infectious material during the production of films.”

It also includes the following passage, “The city may charge, or may direct any other person or entity contracting with the city to administer the film permitting process to charge, entertainment industry customers seeking film permits … a fee sufficient to facilitate compliance with, and enforcement of, this section. All such fees shall be submitted to the City Council for its consideration and approval.”
