LUXEMBOURG — The Luxembourg Independent Audiovisual Authority (ALIA) has levied a fine of 25,000 euros (approximately $28,000) against webcam platform LiveJasmin for failing to comply with provisions of the country’s Electronic Media Law.
Luxembourg’s Electronic Media Law requires providers of video-sharing platforms to implement appropriate measures to protect minors from content “likely to harm their physical, mental, or moral development.” Media regulator ALIA instigated an investigation into LiveJasmin in response to a complaint alleging that adult content was easily viewable on the site without age verification.
LiveJasmin is based in Luxembourg, but ALIA’s investigation examined the conditions of access to the service in all European Union member states, in accordance with what the agency characterizes as its responsibilities under the EU’s Digital Services Act.
In its decision, ALIA states that users in different countries encountered varying degrees of access to explicit content on Livejasmin prior to encountering a paywall, verification or registration requirement. The agency deems this to be a violation of the Electronic Media Law, as well as of its August 2025 ruling following a previous investigation into the site’s compliance with AV rules.
In the course of the investigation, ALIA reports, LiveJasmin operators JWS Americas and JWS International, subsidiaries of Docler Holding, contended that the cases identified were isolated breaches of their content policies, and they had standardized their verification framework across most EU member states.
ALIA agency deemed this insufficient, stating that its August 2025 decision called upon LiveJasmin to implement the same AV solution in all member states by September 2025, but that the site continues to apply a differentiated approach based on varying national legal frameworks.
“A minor accessing the service from Austria, Belgium, Spain, or the Netherlands encounters no obstacles whatsoever and is directly exposed, simply by adjusting their cookie settings, to content containing nudity, self-stimulation, and acts of penetration,” the decision reads.
Clarifying its jurisdiction in the matter, ALIA explained that the “country of origin” principle in the EU’s Directive on Electronic Commerce is intended to subject site operators to the rules of the member state in which they are based, regardless of which other member states might access online content.
“The absence of specific national legislation in the Member State of destination therefore has no bearing on the scope of the suppliers’ obligations, which remain entirely governed by Luxembourg law,” the decision notes.
In addition, ALIA cited “lack of cooperation” from LiveJasmin, which the agency says failed to respond to a request for access to services from its IP address in order to conduct checks on the protection of minors and paywall mechanisms.
Based on these circumstances, ALIA imposed the maximum fine of 25,000 euros.
