Pipedream Files Suit Against Electric Eel

CHATSWORTH, Calif. — Pipedream has filed a trademark infringement suit against Electric Eel for the patented mark “bachelorette party favors.”

On May 8, the court’s clerk notified the court that Electric Eel has failed to respond to the suit.

According to the complaint filed April 14, Pipedream is the owner of the mark “bachelorette party favors” for “paper goods, namely, napkins, party bags, party favors, party hats, pennants, party decorations, table cloths, gift bags, place mats, flags, banners, bags, boxes, bunting, emblems, flags, wrapping paper, name badges and printed invitations.” The patent was registered in 2006.

“In or about August of 2007, Pipedream informed defendant that it was the owner of the trademark and defendant, who at that time had been selling paper goods under the name ‘Bachelorette Party Favors,’ agreed that it would cease manufacturing, selling, and promoting goods that Pipedream alleged were infringing the trademark.”

According to the suit, in April Pipedream learned Electric Eel had allegedly resumed manufacturing and distributing “bachelorette party favors” items.

Pipedream is seeking actual damages, profits and treble damages, as well as attorneys fees and court costs.

Electric Eel was unavailable for comment at post time.
