Makers of Extenze to Pay $1.75M to Settle Advertising Suit

MONROVIA, Calif. — Biotab Nutraceuticals, the makers of the Extenze supplement pill, has agreed to pay $1.75 million in fees to settle a lawsuit alleging false advertising.

The Orange County District Attorney’s Office said the company made unsubstantiated advertising claims about some of its supplements, including Extenze, saying that the pills increase penis size, enhance sexual desire, performance and pleasure.

The district attorney sued the company for violating consumer protection laws.

Biotab hasn’t acknowledged fault or liability, but agreed to the terms of the injunction to prevent future unfair business practices, the Los Angeles Times reported.

The company also must pay restitution to consumers who have not received refunds after filing complaints in 2006 and 2011.

The former owners of Extenze, Dish Direct Inc., paid a $300,000 settlement in 2006 and agreed to change its advertising to remove suggestions that the product's effectiveness has been scientifically tested, according to the Orange County District Attorney's Office.
