The media giant submitted the paperwork to the U.S. District Court for the Southern District of New York on Wednesday. Google in June won big in the first round of the dispute between the two companies over copyright materials on YouTube.

In the June ruling, Google's request for summary judgment was granted by Judge Louis Stanton, meaning that the dispute was never presented to a jury. That move came after Stanton ruled that YouTube was protected under safe-harbor provisions of the Digital Millennium Copyright Act that place the responsibility for informing a Web site owner that copyright material is present on the owner of that material.

Viacom issued a statement following that ruling, saying it would "seek to have these issues before the U.S. Court of Appeals for the Second Circuit as soon as possible."
