Pink Visual Files Suit Against Operator of 7 Tube Sites

NEW YORK — Pink Visual has filed suit against a British Virgin Islands company that operates seven adult-content tube sites, alleging copyright infringement over 92 of its movies allegedly found on the sites.

The sites named in the suit — FreePorn.com, BadJoJo.com, BoysFood.com, FreeViewMovies.com, StileProject.com, PornRabbit.com and PornYo.com — are owned by Two Point Oh Ltd. and are alleged to have allowed "millions of users unfettered and unlimited access to view, copy and redistribute" Pink Visual's content, the suit said.

Two Point Oh — no relation to marketing firm Three Point Ohh!, which is owned by adult veteran Chris Lebrun — also operates its own management company, advertising broker (AdSurve.com), processing company (ProCharge.net) and an affiliate program (GridlockParadise.com).

"All of these companies assist defendant in monetizing the infringing content that populates its infringing sites," Pink Visual said.

Two Point Oh is registered to do business in New York, where the federal suit was filed.

Jessica Pena, Pink Visual's general counsel, told XBIZ that that the case is about direct copyright infringement because site operators allegedly uploaded the content.

"Adult tube site operators cannot infringe on our copyrights while attempting to hide behind the guise of a user generated content site, especially when their site clearly does not have a functioning 'user upload' option," she said.

Pink Visual President Allison Vivas told XBIZ that the company has been forced to work just as hard to protect its copyrights as it is to produce the movies.

"At Pink Visual we work hard on our productions and we are going to continue to work just as hard when it comes to protecting them," she said. "After all, if studios don't value their own content, how can we expect anyone else to?"

The suit seeks declaratory and injunctive relief and damages of up to $13.8 million.
