IntenseCash Sues BoyzTube for $6.4 Million

DENVER — IntenseCash today filed a $6.4 million copyright infringement suit against the operator of gay adult tube site BoyzTube.com for allegedly poaching and streaming its content.

IntenseCash, which owns BrokeStraightBoys.com and BrokeStraightGuys.com, said that BoyzTube's parent company, Sun Networks International Ltd. of the British Virgin Islands, has infringed on 43 separate instances of copyright infringement.

The suit indicated that some of the movies poached and streamed were viewed up to 48,000 times on BoyzTube and include such titles as "Jayce, Sean & Leon," "Jarrett & Mark" and "Daxter & Rabib."

"Defendants have had actual knowledge of the infringing material on BoyzTube.com and/or were aware of facts or circumstances from which infringing activity was apparent on its system or network and/or failed to act expeditiously to remove or disable access to the material upon obtaining such knowledge or awareness," the suit said. 

"This is evidenced by the fact that defendants have a 'studio black list' and solicit users to identify infringing material through its promotion, 'Win a month's full membership, flag a video as copyright for these studios and you will be upgraded for one month — the studios are Corbin Fisher, SeanCody, Titan Media, English Lads and Bel ami.'"

IntenseCash said that the foregoing facts show that BoyzTube is not entitled to the safe harbor protections of the Digital Millennium Copyright Act.

IntenseCash's parent, Colorado-based BluMedia Inc., is asking for injunctive relief, damages, transfer of the domain name BoyzTube to IntenseCash and attorneys fees, among other claims.
