MonsterCockTube Owners Served With Piracy Suit
Titan Media’s parent company, IOGroup, had been trying to serve German citizens Thorsten Palicki and Maik Herrmann for months. But Titan’s Gill Sperlein confirmed to XBIZ on Monday that the pair were served last week at Internext.
The suit alleges that MonsterCockTube’s operators’ business plan “depends on the uploading, posting, display and performance of copyrighted audiovisual works” and that the defendants’ “blatant disregard for copyright laws threatens” online adult businesses, as well as Titan’s business.
The suit said that MonsterCockTube operators pirated at least 15 of Titan’s movies.
MonsterCockTube, now redirecting as MonsterCockLand, offers tube content, as well as video-on-demand material.
“Defendants deliberately and knowingly built a library of infringing works to draw Internet traffic to the subject website, enabling them to sell memberships to view the works while also increasing the value of their business and earning large amounts of revenue,” the suit said.
An amended complaint filed last month said that Palacki and Herrman had been attempting to avoid a suit by attempting to change the ownership of the company into a bogus offshore company, Sunrise Media Ltd., in order to hinder the lawsuit first filed last September.
“Just six days after Antelope Media’s agent received the complaint in this action, [Herrmann and Palicki] formed Sunrise Media Ltd.,” the suit said.
Titan also alleges that to conceal online assets, the defendants transferred the registrations of other owned domain names, including AllRealBareback.com, AlphaMaleCash.com, AaronGiantxxx.com, MuscleNiklasxxx.com, AndyMusclecam.com, MusclesInMotion.net, BigNiklas.com and SixFootSixGuy.com from Antelope Media to Sunrise Media.
The suit also alleges the same transfer with MonsterCockTube.com from Antelope Media to another defendant Newhaven, a Dutch business entity, with the help from Netherlands resident Patrick Schwarz.
Titan noted in a court filing that Herrman and Palicki wrote to the court in October, claiming Antelope Media didn’t own MonsterCockTube and that they would not have the resources to defend against the complaint.
