The suit alleges that Mario Mendoza and Katie Lynn Krzywdzinski, the couple who run the site, “uses the mark ‘Lexus’ in an unwholesome and unsavory context” and therefore could damage the reputation of its cars and company.
LexusCash.com is an amateur adult website that features its signature model along with her girlfriends. The site offers both trial and monthly subscriptions.
Toyota Motor Corp. (Lexus is a division of Toyota) filed suit against Mendoza and Krzywdzinski on May 30 in U.S. District Court. The case has been assigned to Judge Denise Page Hood.
According to court documents obtained by XBIZ, Toyota is alleging trademark and service mark dilution, unfair competition, trademark and service mark infringement and trade name infringement.
Lexus is requesting permanent enjoinment of the Lexus name and service mark. According to court papers Lexus is not seeking monetary damages, just attorneys fees.
An email sent to Mendoza requesting comment was not returned at press time.
