MetArt Sues DrTuber.com for Copyright Infringement

MIAMI — Porn membership site MetArt last month filed a federal lawsuit against DrTuber.com and its operator, claiming copyright and trademark infringement charges after it allegedly found 22 of its copyrighted videos on the adult tube site.

MetArt, in the suit filed by parent company Hydentra LP at Miami federal court, said that the 22 of its copyrighted films were spread over 254 separate URLs when first noticed on DrTuber.com in July.

After sending over DMCA take-down notices, MetArt said the numbers of copyrighted films fell to 13 over 111 separate URLs last month on DrTuber.com.  

The suit against DrTuber.com and operator Igor Kovlchuk is similar to AMA Multimedia LLC’s lawsuit against the company that was reported by XBIZ yesterday.

In that suit AMA Multimedia LLC — the operator of more than 20 porn membership sites, including Passion-HD.com, Tiny4K.com and PornPros.com — claimed DrTuber displayed 28 of its copyrighted works over 33 separate URLs.

MetArt charges eight copyright and trademark claims in its suit against DrTuber.com, including one count over a state claim for unauthorized publication of name and likeness in violation of Florida statutes.

The MetArt suit also alleges DrTuber.com used its trademarks in metatags to lure in users and gain financially by displaying advertisements in close proximity to free videos.

The suit seeks $150,000 for each infringed film as well as a restraining order, among other forms of relief.

The DrTuber.com suit is the latest legal action by MetArt over protection of its copyrights and trademarks.

MetArt has filed numerous other infringement claims, including those against the operators of XVideos.com, Sex.com, AdultPornVideoxx.com, JoJoBaa.net, Motherless.com, KPorno.com, Pornias.com, LikePorno.com, SpankBang.com, Porn69.biz, Porn69.org, PornHub88.com, Sex88.org, PornoWow.com, Tubenn.com, Wixvi.so, Wixvi.com, HDPorn1080.com, HDPorn1080.net, SexTVx.com, SexSeeVideo.net and PornVideoXO.com.

MetArt filed one suit against adult entertainment conglomerate MindGeek over films found on its PornHubPremium.com property but later dropped its claims altogether.

Parent company Hydentra LP’s suite of membership websites include MetArt.com, SexArt.com, Errotica-Archives.com, EroticBeauty.com, TheLifeErotic.com, RylskyArt.com, MichealNinn.com, ALSScan.com, VivThomas.com, EternalDesire.com, Stunning18.com, HollyRandall.com, Domai.com, GoddessNudes.com, MagikSex.com and BBFilms.com.

A MetArt spokesman declined comment on the suit to XBIZ.
