Smash Pictures Settles With German Distributor Paradise Films

CHATSWORTH, Calif. — Smash Pictures on Monday said it has settled a long-running suit against Germany-based Paradise Films over allegations that the company distributed Smash productions outside its contract.

Smash Pictures did not disclose any terms of the settlement, which was reached last week.

Paradise Films and its owner, "Kralik" aka "Nicholas," had been charged in the civil suit with attempting to resell Smash Pictures content to Orion (Germany) to use in its DVD compilations, Smash said.

Smash, however, said that it thwarted the attempt to sell the productions even after "fake contracts" had been used.

Smash Pictures, which had litigated the case in Germany for the past three years, said that Paradise FIlms is a former "DVD-rights distributor" in which "rights granted were solely to distribute our films in the country of Germany."

"On top of this, Paradise Films was caught doing deals outside of his territory to the Netherlands IPTV system Erocom and Kudeta using the Smash footage," Smash said in a statement. "It didn’t stop there, Smash Pictures also discovered its footage on Telekom/Erotic Lounge, the largest German IPTV system too."

Smash Pictures was represented by German attorney Andre Schenk.
