Perfect 10 Files $5M Suit Against Depositfiles.com

LOS ANGELES — Perfect 10 has filed another copyright infringement suit against a file storage site for harboring its content.

Depositfiles.com's operators on Tuesday were hit with a $5 million suit by Perfect 10, which called the business "not a legitimate file storage company and has none of the characteristics of one."

Perfect 10 says much of its copyrighted ntent has been found on Depositfiles.com, which  "has become among the 240 most popular websites on the Internet, primarily because of the massive quantities of unauthorized copyrighted works that it makes available to its members at far below what legitimate businesses that have the rights to offer such materials charge."

In the suit filed at U.S. District Court in San Diego, Perfect 10 said that Depositfiles.com is owned by Seyshelles-based Kalmet Investments Ltd.

Perfect 10 waged a similar suit against Texas-based Giganews Inc. and Livewire Services Inc., earlier this year.

The company claimed in that $25 million suit, just as in this one, that the operator was illegally posting its copyrighted images on its servers.

Perfect 10's Norm Zada, who founded the company, earlier told XBIZ that he's fighting rampant big-scale piracy because he's "trying to protect the property Perfect 10 owns.

"If you get robbed you do something about it," he said. "Copyright infringement is copyright infringement, and cyberspace shouldn't be any different."

XBIZ wasn't immediately able to reach Kalmet executives for comment.
