ICM Registry Says It Wants to Offer Priority Rights

PALM BEACH, Fla. — ICM Registry plans to give priority rights to trademark holders during three sunrise periods, if and when the .XXX domain launches.

ICM Registry’s Stuart Lawley told XBIZ sunrise periods are “the launch process for a new TLD that gives priority rights to trademark holders and in the case of .XXX, uniquely, existing holders of names in .com, .net and other TLDs.”

But Diane Duke, the Free Speech Coalition's executive director, says that Lawley is getting ahead of himself with the .XXX proposal.

"Just a reminder, .XXX has not been passed," Duke told XBIZ Tuesday night.

She also noted Lawley has broken his word over some of the tenets of his .XXX proposal.

"Lawley had promised our industry the right to park addresses, a promise he clearly doesn’t plan on keeping," said Duke, who told XBIZ last week that Lawley went against another promise over using the numbers of pre-reserved .XXX domains to help lobby his cause.

With the sunshine periods, Lawley said the first period would allow owners of porn-related trademarks to claim their .XXX domain names and use them as normal.

The second would enable non-porn companies that don’t want their brands associated with adult material to basically “turn off” their trademarks in .XXX domains, paying a one-time fee.

And the third proposed sunrise would allow owners of non-trademarked porn domains in other TLDs, such as .com, to get their equivalent .xxx using an automated Whois check.

The process is being handled by Valideus, a British IP consultancy.

.XXX could get be approved by ICANN onFriday at their board meeting in Cartagena, Colombia.
