UGotPosted Operators Hit With Another Lawsuit

CHICAGO — Another Jane Doe has filed a lawsuit against the operators of UGotPosted.com.

An unnamed Cook County woman claims in her suit filed Friday at U.S. District Court in Chicago that the revenge porn site contains 16 unauthorized pictures of herself posing in various positions, mostly nude.

Doe said that she received a text message in February from an unknown phone number implying that nude photos of here were posted on the revenge porn site.  

Later, Doe clicked on the links for the search results bearing her name and discovered 14 nude photos of herself with UGotPosted watermarks. Two clothed photos of herself also were published, as well as her town where she lived and her place of employment.

That same day Doe sent an email requesting immediate removal of the photos through a DMCA takedown notice saying that the operators were infringing on her copyright ownership of the pics.

After two weeks without a response, Doe claims she sent another request that fell on deaf ears.

The suit, which seeks unspecified damages and a preliminary and permanent injunction ordering the removal of the pics, says that the operators  "wrongful conduct was so outrageous that it cannot be tolerated by civilized society."

Doe charged that the defendants defamed her by putting her in a false light by posting the pics. She also said that the defendants are liable for intentional infliction of emotional and that their conduct violated the Illinois Right to Publicity Act.

Doe's suit is just the latest of a number of claims against Blue Mist Media LLC and owners Eric Chanson of New Jersey, as well as his parents, and associate Kevin Bollaert.

Adult entertainment attorney Marc Randazza in May filed two civil cases against Blue Mist on counts of distributing child pornography and failing to comply with 18 U.S.C. § 2257 in May.

Randazza is representing one client from California and another from Ohio. According to the Los Angeles case court document, the site posted sexually explicit images of a 14-year-old's public area.

Revenge porn websites, such as UGotPosted, profit through distribution of sexually explicit photos of unwitting men and women provided by hackers and ex-lovers. The sites usually make their revenue through advertising.

Oftentimes, the photos are accompanied by personal information and links to their social media pages, including those on Facebook, as well as home towns and addresses.
