MetArt Asks Appeals Court to Revive Infringement Case

MIAMI — The MetArt Network recently filed an appeal after a federal judge granted summary judgment to defendant Sun Social Media Inc., which operates a number of adult tube sites including PlayVid.com and FeedVid.com that had been fingered for copyright infringement.  

Earlier this month, MetArt asked the 11th U.S. Circuit Court of Appeals to review an omnibus order set by U.S. District Judge Ursula Ungaro last month that effectively sunk its case by denying its motion for partial summary judgment and granting summary judgment to Sun Social Media.

MetArt filed the infringement suit last summer against Sun Social Media; its director, Constantine Luchian; and its operating director, Konstantin Bolotin over 44 separate movies that streamed on its adult tube sites.

MetArt said that Sun Social Media and its principals not only did not honor DMCA notices but also failed to implement a reasonable repeat infringer policy for its tube sites, which included a “MetArt Channel” on each that served as an all-in-one place to permit users to browse and choose specific videos.

MetArt filed eight causes of action, including copyright and trademark infringement, and sought an injunction, transfer of the website’s domain name and up to $150,000 per instance of copyright infringement.

Sun Social Media operates tube sites PlayVid.com, PlayVids.com, FeedVid.com and FeedVids.com.

Luchian, Sun Social’s operating director, is a familiar name in online adult entertainment industry circles. For years he has acted as DMCA agent for numerous websites, including xHamster.com, AnySex.com and DrTuber.com, and scores of file-sharing sites like HotFile.com and DepositFiles.com. He’s also the DMCA agent for Webzilla Inc., a company utilized by Sun Social Media to provide web services to its tube sites.
