NEW YORK — Punctuality counts.
Four exotic dancers who alleged they were misclassified as independent contractors while working at New York Dolls, Private Eyes and Flashdancers Gentlemen's Clubs found their claims denied by a federal judge this week.
The four each had applied to cash in on a $4.3 million settlement made by the strip clubs, but found themselves on the short end of the stick because their claim forms were mailed between 11 and 33 days after the due date. Hundreds of other exotic dancers were eligible for claims.
U.S. Magistrate Judge Ronald Ellis ruled this week that Analia Guarino, Iveta Deprospo, Julia Chu and Nicole Lockett can’t participate in the settlement because of their tardiness.
Collectively, the four women were denied $43,000 with Ellis’ ruling.
Each had reasons why their claims were late — including change-of-address mix ups or because their attorneys just forgot to mail the forms in.
