Obenberger to Explain New 2257 at Internext

CHICAGO — With the signing of the Adam Walsh Child Protection and Safety Act of 2006, also known as H.R. 4472, adult entertainment industry attorney J.D. Obenberger has endeavored to educate the industry on the impact the law will have.

The law, now in effect, has raised both questions and concerns among members of the adult entertainment industry. In response, Obenberger has published several tools on his website to address the issues raised by the now amended 2257 federal record-keeping requirement.

“President Bush signed H.R. 4472 into law today, effecting substantial changes in the compliance requirements affecting ‘secondary producers’ of explicit sexual material, eliminating doubt that the statute requires republishers and webmasters to maintain and make available for inspection the same records which the producing photographer/videographer must maintain,” Obenberger said.

To aid the industry, Obenberger has posted the revised 2257 text, a redlined document graphically illustrating the changes as well as a full copy of the new law.

Obenberger will present a two-hour workshop on issues surrounding adult entertainment online — including a discussion on obscenity and 2257 — Aug. 5 at Internext in Hollywood, Fla. He also will be a panelist on an Internext legal seminar the following day, Aug. 6, at 10 a.m.

In the meantime, Obenberger stressed that the advice he has always given clients — to deal exclusively in material for which they can keep records — remains the best policy.
