Playboy Sues Rapper for Infringement

CHICAGO — Playboy Enterprises has filed a lawsuit against rapper Drake for copyright infringement.

According to the legal documents, Playboy claims that Drake, whose real name is Aubrey Graham, Cash Money Records and Universal Music Group are infringing on its copyright with the use of the song “Fallin In Love” by Hamilton, Joe Frank and Dennison/Reynold.

The rights of the original song are owned by Playboy Music Inc. and Playboy Enterprises. The song can be allegedly heard at the beginning of Drake’s track and is being used without permission, according to Playboy.

The suit claims the defendants, “knew or should have reasonably known that the recording was protected by copyright” and that “each defendant continues to infringe upon plaintiff’s rights in and to the copyrighted sound recording.”

Playboy adds the infringement is “continued” and “ongoing.” The company wants an injunction to stop the sales and distribution of the record and the defendants held responsible for Playboy’s costs and attorneys fees.
